Illinois Divorce Laws
In order to file for divorce in Illinois, you or your spouse must be a state resident for at least 90 days. You may file a petition in the circuit court in the county where either of you live. Since Illinois is a no-fault state, you may file for divorce based on irreconcilable differences. The former fault-based grounds for divorce, such as adultery, substance abuse, abandonment, and others, have all been eliminated under Illinois law.
There are two main types of divorce: contested and uncontested divorce. In an uncontested divorce, both spouses agree on all issues of a divorce (e.g. child custody and support, maintenance, property division, etc.) and can finish their divorce without having to go through significant court litigation.
On the other hand, spouses engage in a contested divorce when they are unable or unwilling to reach an agreement regarding at least one of the divorce-related issues. In a contested divorce, each side retains an attorney and significant litigation may ensue if the parties cannot resolve their differences.
